Valta-asemat, in Finnish competition law often referred to in plural as valta-asemat or valta-asemien, describe a market position in which a company has significant economic strength enabling it to act with a high degree of independence from competitors, customers, and suppliers. A valta-asema is not defined by a single numerical threshold; instead, its existence is assessed from multiple factors, including market definition, market share, barriers to entry, network effects, access to key inputs, and customer dependence. The concept is used to evaluate whether a firm can influence prices, terms, or competitors over time.

Valta-aseman arviointi rests on a combination of structural and behavioral indicators. Structural factors include market concentration, entry barriers, control of essential facilities, and the presence of network effects. Behavioral indicators examine how a firm uses its position in practice, such as whether it engages in strategies that foreclose competition, discrimination between customers, or leveraging power across related markets. In Finland, as in the EU, market power assessments inform whether conduct constitutes abusive practices.

Abuse of a dominant position is prohibited under Finnish competition law and EU competition rules. Prohibited behavior can include setting unfair purchase or selling prices, limiting production, limiting market access, applying discriminatory or non-transparent terms, or tying products beyond what is necessary for a contract. Enforcement is carried out by national authorities, such as the Finnish Competition and Consumer Authority (KKV), and, for cross-border matters, by the European Commission. Remedies may include penalties, behavioral changes, or structural measures to restore competitive conditions.
