Pracodawcapracownik is a term that describes the employer–employee relationship in Poland. It refers to the bilateral arrangement in which a pracodawca engages a pracownik to perform work under specific terms, typically within an employment contract and under applicable labor law.

Pracodawca is responsible for organizing work, assigning tasks, setting conditions of employment within the bounds of the law, and paying remuneration. The employer must ensure safe working conditions, provide the necessary tools and training, and make required social security and health insurance contributions. Pracodawca also has duties related to non-discrimination, equal treatment, and respect for workers’ rights and privacy.

Pracownik, in turn, performs assigned tasks, follows lawful orders and workplace rules, observes confidentiality where required, and strives to fulfill duties in a professional and diligent manner. The employee has the right to fair remuneration, safe working conditions, rest breaks, vacation, and social protections, and may participate in trade unions or employee representative bodies where present.

The legal framework governing the relationship is primarily the Labor Code (Kodeks pracy) in Poland, along with related acts. The most common form of formal relationship is the umowa o pracę (employment contract), which provides protections such as notice periods and certain job security. Other civil-law arrangements, such as umowa zlecenie or umowa o dzieło, do not create an employment relationship in the same sense and are governed by civil law rather than the Labor Code.

Disputes between employer and employee may be resolved through courts or labor authorities, such as the Państwowa Inspekcja Pracy (PIP), and, when relevant, through collective agreements and unions.
