Haszonbérlet

Haszonbérlet is a contractual arrangement in Hungarian civil law by which the owner of a thing or land grants another person the right to use it and enjoy its fruits for a fixed term in exchange for rent. The leaseholder (haszonbérlő) acquires the right to use the property and to derive its proceeds, but ownership remains with the owner (haszonbérbeadó). The arrangement is commonly used for agricultural land, forests, or other yield-producing property, but can apply to various fungible assets.

Subject matter and scope: Haszonbérlet covers property capable of producing profit. The contract specifies the purpose of use, the duration, the rent (haszonbérleti díj), and how fruits or yields are treated. The owner retains ownership and the right to receive rent, while the leaseholder gains the right to use the property and to collect its natural and economic fruits in accordance with the contract.

Rights and obligations: The haszonbérlő must use the property as agreed, maintain it within the terms of the contract, and pay the agreed rent. The leaseholder may be entitled to cultivate, harvest, or otherwise obtain profits from the property, subject to contract terms. Subleasing or transfer of the contract typically requires the owner’s consent, unless the contract provides otherwise. The owner must ensure the property is suitable for use and must refrain from unduly interfering with the lease.

Duration and termination: Haszonbérlet is usually for a fixed term and may be renewable by agreement. It ends upon expiry, breach of contract, mutual consent, or other termination events provided in the contract or applicable law. After expiry, rights revert to the owner unless renewed or redefined.
