They most often operate within the works council (ondernemingsraad, OR) and, in smaller organizations, within a personnel representation body (personeelsvertegenwoordiging). Their primary role is to safeguard employees’ interests and to facilitate dialogue between staff and management.

Legal framework and powers are typically defined by national law and sectoral regulations. In the Netherlands, the Wet op de ondernemingsraden (WOR) provides the framework for works councils. The OR or equivalent body has the right to be informed by management about important business decisions, can give advice, and in certain cases may have a formal right of consent. Beyond information and consultation, employee representatives may address topics such as working conditions, wages and salary policy, reorganizations, health and safety, and training. They often monitor compliance with labor laws and collective agreements and can initiate or participate in negotiations.

Election and functioning commonly involve representatives elected by the workforce, serving fixed terms. The size of the representation depends on company size, and the body typically meets regularly with management to discuss concerns, propose measures, and track agreed actions. In many contexts, they also partake in the negotiation of collective labor agreements (cao) and in dispute-resolution processes within the workplace.
