Mediation and negotiation emphasize confidentiality and control over outcomes, while litigation provides formal rules, precedents, and appellate options, though it can be slower and more public.

Choice of method depends on factors such as the dispute type, desired confidentiality, relationship between parties, cost considerations, and the need for a final, enforceable resolution. ADR clauses, contract terms, and institutional rules commonly shape how disputes are managed, increasingly favoring early resolution, predictability, and collaborative problem-solving.
