Rechtsvorming

Rechtsvorming is a Dutch term used to describe the process by which rights and legal norms are formed, clarified, or expanded through the interpretation and application of law. It encompasses judicial interpretation, doctrinal development, administrative practice, and, to a lesser extent, legislative changes that respond to interpretive gaps or evolving social needs.

Mechanisms of rechtsvorming include judicial decisions by courts, especially supreme or constitutional courts, which interpret statutes and the constitution to create or extend rights through precedent. Legal doctrine and scholarly work influence judicial reasoning and professional practice. Administrative agencies can develop policy interpretations that function as de facto law. Parliament can codify or revise rules in response to these developments, influencing future rechtsvorming.
