Vertragliches is the adjectival form and, less commonly, a noun in German used to describe matters arising from or governed by contracts. It refers to the realm of contract law and contract-based obligations.

In everyday language, phrases such as vertragliche Pflichten (contractual duties), vertragliche Vereinbarungen (contractual agreements), and vertragliche Regelungen (contractual arrangements) are common. The term can also function as a nominalized form: das Vertragliche, used to refer to contract-related matters in a discussion.

In legal context, vertragliches encompasses obligations that arise from a voluntary agreement between two or more parties. These can be express terms set out in a contract or implied terms inferred from the contract, conduct, or law. Contractual obligations include payment obligations, delivery or performance, and confidentiality, among others. German civil law (the BGB) governs these obligations; key rules cover performance, breach, and remedies. When a party breaches a contract, the other may seek damages (Schadensersatz gemäß §280 BGB), demand performance (Erfüllung), or, in some cases, termination or avoidance (Rücktritt, Kündigung).

Differences to statutory or non-contractual claims: vertragliche claims arise from the contract itself, whereas deliktische (tort) claims arise from unlawful acts outside the contract (for example, negligence). In international or commercial contexts, standard contract terms (Allgemeine Geschäftsbedingungen, AGB) often shape vertragliche Inhalte.
