Põhivabadusi are the fundamental freedoms and civil liberties guaranteed to individuals in a democratic state, forming the core of personal autonomy, dignity, and political participation. They provide the framework within which people may think, communicate, gather, worship, move, and live with privacy and legal protection. The concept is grounded in liberal democratic traditions and is protected by national law and international obligations.

Typical elements of põhivabadusi include freedom of thought, conscience, and religion; freedom of expression and information; freedom of assembly and association; freedom of movement and residence; privacy and data protection; and the right to a fair trial, equality before the law, and non-discrimination. These rights are not absolute; they may be restricted by law to safeguard public safety, health, morals, or the rights and freedoms of others, provided such restrictions are necessary and proportionate.

In Estonia, põhivabadusi are primarily enshrined in the Estonian Constitution (Põhiseadus) and complemented by legal acts and court interpretations. The Constitution establishes the conditions for limiting rights and ensures judicial review, including by the Supreme Court (Riigikohus) to protect fundamental liberties.

Internationally, Estonia is bound by the European Convention on Human Rights and the EU Charter of Fundamental Rights, which reinforce and harmonize national protections.
