consuetudine

Consuetudine is the habitual practice of a community that, through repeated conduct over time, acquires normative significance. The term comes from Latin consuetudo, meaning customary practice or familiarity, and is used in legal and sociocultural contexts to denote rules or expectations that arise from long-standing behavior rather than formal enactment.

In legal systems, consuetudine can function as a source of law that fills gaps, interprets ambiguities, or confirms established practices. It is not, however, supreme over written statutes: a rule grounded in custom typically applies only if it is generally accepted, long-standing, uniform, and reasonably certain, and it must be compatible with the rest of the legal order. In civil-law traditions, consuetudine may influence private law, including contracts, property, and commercial practice, particularly where no statutory provision governs the issue. Judges may invoke customary norms to resolve disputes or interpret terms, provided the practice is proven and recognized as having legal effect.

In international law, the term is used for customary international law, which arises from widespread state practice accompanied by a belief that the practice is legally required (opinio iuris). Such rules bind states even without a treaty.

Outside the legal sphere, consuetudine also denotes social custom or habit: practices, etiquette, or traditions that are widely observed within a community, even if not codified. It is often contrasted with usanza or uso, which refer to customary behavior in more specific contexts.
