Suhtlusõigused

Suhtlusõigused, often translated as "rights of communication" or "rights of contact," refers to legal provisions that govern the relationship between a child and their parents or other significant individuals when those individuals are not living together. These rights are primarily concerned with ensuring the child's well-being and maintaining their connections with both parents, even after a separation or divorce.

In Estonian law, suhtlusõigused are outlined in the Family Law Act. They typically grant a non-custodial parent the right to maintain contact with their child. This can include regular visits, phone calls, video calls, and participation in important family events. The specific nature and extent of these rights are usually determined by mutual agreement between the parents or, if an agreement cannot be reached, by a court.

The paramount consideration when determining suhtlusõigused is always the best interests of the child. This means that the child's physical, emotional, and psychological well-being takes precedence over the parents' desires. Courts will assess various factors, such as the child's age, wishes, and the practicalities of the proposed contact arrangements.

If one parent obstructs or denies the other parent their suhtlusõigused without a valid legal reason, the non-custodial parent may seek legal remedies. This can include applying to the court for enforcement of the contact arrangements or, in extreme cases, seeking a review of custody arrangements. The overarching goal is to foster a stable and supportive environment for the child, promoting healthy relationships with both parents.
