Perusoikeusvaltion

Perusoikeusvaltion, or the constitutional rights state, is a political-legal concept describing a state in which public power is limited by a constitution and by fundamental rights. In a perusoikeusvaltio, individuals have enforceable rights against the state, and government actions are subject to legal safeguards and judicial review. The concept emphasizes that power is exercised under the law and that rights are protected from arbitrary state action.

Key elements include the rule of law, the separation of powers, and an independent judiciary. The legality principle requires that authorities act only on lawful mandates and that procedures are transparent and contestable. Fundamental rights such as freedom of expression, assembly, religion, privacy, equality before the law, and due process are protected against ordinary and extraordinary state measures.
