Elatusjärjestelyt

Elatusjärjestelyt, often translated as maintenance arrangements or alimony, refers to the legal and practical measures established to ensure a person's financial needs are met, particularly after a separation or divorce. These arrangements are designed to support a spouse, former spouse, or children, aiming to prevent economic hardship for those who are financially dependent on the other party.

In Finland, elatusjärjestelyt are typically determined by court decisions or mutual agreements between the parties. The primary focus is often on child maintenance, where one parent pays financial support to the other parent for the upbringing and care of their shared children. Factors influencing child maintenance include the child's needs, the parents' ability to pay, and the amount of time the child spends with each parent.

Spousal maintenance, or elatusapu eläkkeensaajan puolisolle, can also be ordered if one spouse is unable to support themselves financially after a divorce, especially in long-term marriages where one spouse has been primarily responsible for the home. The duration and amount of spousal maintenance are assessed on a case-by-case basis, considering factors like age, health, and earning capacity.
