The DigitaleDiensteGesetz (Digital Services Act, or DSA) is a comprehensive European Union regulation aimed at harmonizing the rules governing digital services and platforms across member states. Introduced as part of the broader Digital Markets Act (DMA) package, the DSA entered into force in November 2022 and will be fully applicable from February 2024, with stricter provisions for very large online platforms (VLOPs) taking effect earlier, in August 2023.

The law sets clear obligations for online intermediaries, including search engines, social media platforms, marketplaces, and hosting services. Key requirements include the implementation of risk management systems to detect and address illegal content, such as hate speech, disinformation, and illegal products. Platforms must also establish transparent moderation policies, provide users with effective notice-and-action mechanisms, and cooperate with authorities during investigations.

The DSA introduces a tiered approach based on the size and risk profile of platforms. Very large online platforms (VLOPs), defined as those with over 45 million monthly active users in the EU, face additional obligations, including independent audits, algorithmic transparency, and the appointment of a representative within the EU. Smaller platforms are subject to lighter but still significant compliance requirements.

Enforcement of the DSA falls under the jurisdiction of national authorities, with the European Commission acting as a coordinator. Violations may result in fines of up to 6% of a company’s global annual turnover, with repeated or severe breaches potentially leading to bans from the EU market. The regulation also strengthens user rights, such as the right to appeal content moderation decisions and access to grievance mechanisms.

The DSA aims to create a safer, more transparent, and more accountable digital environment while fostering innovation and competition. It builds on earlier EU initiatives like the eCommerce Directive but expands its scope to address modern challenges posed by large-scale digital services.
