BfDI

BfDI stands for the Bundesbeauftragte für den Datenschutz und die Informationsfreiheit, the German federal independent authority responsible for data protection and freedom of information in the federal administration. The office oversees how federal authorities process personal data and handle information requests, and it serves as the main supervisory body for GDPR compliance at the federal level.

Functions and powers

The BfDI investigates complaints from individuals regarding the processing of their personal data by federal authorities, conducts audits, and issues decisions or recommendations to remedy violations. It provides guidance on data protection practices, privacy-by-design considerations, and information-access procedures under applicable law. The office also promotes transparency and facilitates access to information as required by information freedom laws at the federal level. In addition, the BfDI publishes opinions, guidelines, and a yearly report on its activities.

Scope and limitations

The BfDI’s remit covers federal authorities, including agencies and units of the federal government. It does not replace the data protection authorities of the German states (Länder Datenschutzbehörden), which handle state and non-federal matters. For private-sector data processing, other authorities or courts may be involved depending on the context. The BfDI works within the framework of the General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG) and coordinates with other national and European bodies.

Relations and governance

The BfDI operates as an independent federal authority and is accountable to the German Parliament. It cooperates with state DPAs and participates in European and international privacy governance through bodies such as the European Data Protection Board. The office also engages in public education on data protection and information rights.
