Ausbildungsvertrag, in the German vocational training system, is a written agreement between an employer and an apprentice that governs the conduct, duration, and content of the training. It formalizes the apprenticeship, sets the expectations for both parties, and creates the legal basis for the trainee’s education and compensation.

The legal framework is primarily provided by the Berufsbildungsgesetz (BBiG). The corresponding Ausbildungsordnung defines the required training content and occupational objectives for a given occupation. The contract itself should be concluded in writing and is typically registered with the competent body, such as the Industrie- und Handelskammer (IHK) or Handwerkskammer (HWK). The registration ensures formal recognition of the apprenticeship and access to official examinations.

Typical contract contents include the start date and duration of the training, the place of training and the training company, a structured training plan or learning objectives, and the agreed Ausbildungsvergütung (apprentice’s salary), as well as working hours, holidays, and leave. It also outlines duties and rights of both parties, supervision arrangements, the obligation of the apprentice to participate in training measures, and the employer’s obligation to provide proper instruction and a safe working environment. confidentiality, safety rules, and compliance with workplace policies may also be included.

The contract commonly includes details on the probationary period, which allows for early termination if the training relationship proves unsuitable. Endpoints include the successful completion of the final examination, which leads to the award of a recognized professional qualification.
