Selfauthenticating, or self-authenticating documents, refers to items that can be admitted as authentic in legal proceedings without requiring extrinsic testimony or additional evidence of their authenticity. The concept is used to streamline evidence handling by recognizing certain classes of documents as authentic by their own nature or by statutory or rule-based provision.

In the United States, the Federal Rules of Evidence provide several categories of self-authenticating documents. These commonly include official publications, domestic public documents (such as those bearing an official seal or signature), certified copies of public records, newspapers and periodicals, trade inscriptions, acknowledged documents, and notarially certified copies of public records or commercial papers. Foreign documents can also be self-authenticating if accompanied by an appropriate authentication certificate, depending on the rule and the jurisdiction. Once a document falls into a self-authenticating category, the burden generally shifts to the opponent to challenge authenticity by presenting contrary evidence.

Limitations exist. Self-authentication does not guarantee admissibility in every case, and documents may still be excluded on grounds such as relevance or authenticity challenges that go beyond the document’s category. Some items require additional verification for specific contexts, and practitioners must still comply with other evidentiary rules, including authentication of sources, chain of custody, and proper authentication of signatures when applicable.
