Kontitutive is a term used in philosophy of social theory to refer to rules, norms, and practices that do more than regulate behavior: they constitute or bring into existence social realities, institutions, and identities. Kontitutive elements specify what counts as a particular entity, status, or practice, and through such specification they enable those phenomena to exist within a given social system. This contrasts with regulative rules, which govern activities once a social order has already been established.

In this view, social facts such as money, marriage, or corporate personhood arise because participants jointly accept and follow kontitutive norms that count certain actions, utterances, or entities as valid instances of those facts. For example, the designation of a legal person or a currency unit is not merely a description of preexisting conditions; it is produced through constitutive agreements, procedures, and recognitions that count certain acts as creating or recognizing those entities.

The concept is often discussed in relation to constitutive rules, social ontology, and institutional theory. Proponents argue that many social phenomena depend on such constitutive commitments and that understanding them helps explain how institutions gain authority and persistence. Critics question the move from language and norms to ontological claims about existence, and they warn of potential circularity in defining entities by the rules that constitute them.

Kontitutive appears in philosophical writings and translations as a cognate of constitutive or constitutory discussions across languages. It remains a useful label for analyzing how social order is produced and maintained through normative practices rather than merely described.
