Extraterritorial refers to the exercise of authority, laws, or jurisdiction beyond a country’s ordinary territorial boundaries. In international law, extraterritoriality arises when a state claims legal authority over actions occurring outside its borders, or over persons who are not present within its territory. It is typically discussed in relation to criminal, civil, and regulatory contexts, and is balanced against the principles of state sovereignty and non-interference.

There are several bases for extraterritorial jurisdiction. The nationality principle allows a state to regulate the conduct of its own nationals abroad. The passive personality principle permits a state to claim jurisdiction over offenses committed against its nationals by non-nationals abroad. The protective principle allows a state to assert jurisdiction over acts abroad that threaten its security or essential interests. The universality principle holds that certain crimes, such as piracy or genocide, are subject to universal jurisdiction regardless of where committed or the nationalities involved.

Applications vary by country and issue. In modern regulation, extraterritorial reach is seen in anti-corruption and anti-money-laundering laws, international sanctions, and certain trade or export controls. Enforcement can be controversial, as overreaching claims risk conflicts with other states and undermine sovereignty. Proponents argue extraterritorial rules deter cross-border crime and protect national interests, while critics warn of legal overreach and dangers to international cooperation.

In practice, states often rely on treaties, mutual legal assistance, or extradition to address cross-border matters, rather than unilateral action alone. Extraterritorial jurisdiction thus reflects a tension between safeguarding interests beyond borders and respecting the territorial sovereignty of other states.
