Vanhentumisaika

Vanhentumisaika refers to the period after which a legal claim or right can no longer be enforced in court due to prescription. In Finnish law, it sets the time limit within which a creditor must bring a claim or otherwise pursue the right; once the period expires, the claim may be dismissed if the defendant raises prescription as a defense. The term is most commonly used in civil and commercial contexts, but can appear in relation to various types of obligations and rights.

The length of the vanhentumisaika varies by the type of claim. Different categories of obligations—such as contractual claims, torts or damages, consumer debts, or employment-related claims—are governed by different prescribed periods, and there can be special rules for particular situations. Effect and practical implications: When the vanhentumisaika has expired without interruption, the claim generally loses enforceability in court, and the debtor may not be compelled to perform. The concept is a key limiter of long-drawn-out disputes and provides finality after a defined time.
