Strafregistern

Strafregistern, commonly referred to in German as Strafregister, is an official governmental record that lists individuals’ criminal convictions and related procedural data. It serves as a standardized source of information for background checks and for decisions in employment, licensing, security clearances, housing, immigration, and judicial or administrative proceedings. The register helps authorities assess risk, determine eligibility for certain rights or duties, and monitor the legal status of sentences over time.

Typical contents include identifying data (such as name and date of birth), offenses and dates of conviction, the court or authority that imposed the sentence, and the current status of the conviction (active, spent, or expunged). The handling of juvenile records, rehabilitation notices, and the distinction between minor and serious offenses vary by jurisdiction. Some registers also record suspension, probation, or completed rehabilitation.

Access to Strafregisters is generally restricted to protect privacy. Public authorities and certain authorized bodies may obtain information for legitimate purposes; individuals commonly have the right to request their own record or to obtain an official certificate of conduct or a similar document. Employers or organizations may request information only with consent and under applicable data-protection and employment laws.

Retention and deletion rules differ by country. Convictions may become spent after a defined period, or may be deleted or restricted from disclosure under specific conditions. Certain serious offenses may remain accessible for defined purposes, such as national security, licensing, or judicial oversight.

National implementations vary. Germany maintains a central federal criminal register (Bundeszentralregister) used to issue certificates of conduct (Führungszeugnis); Austria maintains its own Strafregister with related procedures. Cross-border use and EU-wide checks also exist, subject to national and EU data-protection standards.
