Sotarikoslainsäädäntö

Sotarikoslainsäädäntö refers to the body of laws that define and penalize war crimes. These laws are rooted in international humanitarian law, also known as the laws of armed conflict. The primary goal of sotarikoslainsäädäntö is to protect individuals who are not, or are no longer, participating in hostilities and to restrict the means and methods of warfare.

Key international treaties that form the basis of sotarikoslainsäädäntö include the four Geneva Conventions of 1949 and their Additional Protocols. These conventions outline protections for wounded and sick soldiers, prisoners of war, and civilians in times of war. They also establish rules regarding the conduct of hostilities, such as prohibitions on attacking civilians, hospitals, and cultural property.

War crimes encompass grave breaches of these conventions, as well as other serious violations of the laws and customs applicable in international armed conflict. Examples include wilful killing, torture, inhuman treatment, unlawful deportation or transfer, and taking hostages. Sntarikoslainsäädäntö also applies to grave breaches in non-international armed conflicts.

The principle of universal jurisdiction allows states to prosecute individuals for war crimes regardless of where the crime was committed or the nationality of the perpetrator or victim. International Criminal Courts, such as the International Criminal Court (ICC), also play a significant role in bringing perpetrators of war crimes to justice.
