Oikeusturvan

Oikeusturva, or oikeusturvan in the genitive form, refers to the protection and enforceability of individuals’ rights by the Finnish legal system and, more broadly, by international and European law. It encompasses both substantive rights and procedural safeguards to ensure that state actions and public administration respect individual freedoms and that rights can be defended in practice.

Key elements of oikeusturva include due process and fair procedure in administrative and judicial decision-making, access to impartial and independent courts, and effective remedies. Individuals must generally be given the opportunity to be heard, reasons for decisions must be provided, and decisions should be subject to review or appeal. Legal aid and affordable access to legal representation support equal protection under the law, and protections against arbitrary or discriminatory state action are essential components.

The institutional framework in Finland supports oikeusturva through constitutional guarantees, the judiciary, and oversight bodies. The Constitution (perustuslaki) sets out fundamental rights and the principle of legality. Administrative courts provide review of public authority acts, while the Ombudsman and the Chancellor of Justice supervise legality and protect individual rights in the exercise of public power. These actors help ensure that administrative and executive actions comply with law and respect human rights.

Oikeusturva is reinforced by international and European law, notably the European Convention on Human Rights and the EU Charter of Fundamental Rights, which influence national interpretation and enforcement of rights. The concept thus covers both national constitutional protections and the broader framework of human rights that Finland is bound to uphold.
