Mediátorai are professionals who assist with dispute resolution by guiding dialogue between conflicting parties and helping them reach a voluntary agreement outside of the court system. They act as neutral facilitators, not as judges or arbitrators, and they do not decide the outcome.

The mediation process typically begins with an agreement to mediate and an explanation of ground rules. In joint sessions the mediator helps parties identify interests, articulate concerns, and explore options. Private caucuses may be held to discuss sensitive issues. The goal is to produce a settlement that reflects the parties' needs and can be formalized into a binding contract, where desired, while preserving confidentiality.

Qualifications and ethics: many jurisdictions require formal training in conflict resolution and mediation, and professional mediators may seek certification from national or regional bodies. Ethical standards usually emphasize neutrality, voluntary participation, informed consent, confidentiality, and avoidance of conflicts of interest.

Benefits and limitations: mediation is often faster, less costly, and better at preserving relationships than litigation. However, it requires voluntary participation, and agreements may be non-binding unless contractually or legally enforceable. Mediation is less appropriate for cases involving power imbalances without safeguards, or matters requiring urgent coercive authority or criminal adjudication.

Global and regional context: mediation is widely used in civil, commercial, family, and workplace disputes. In many countries, public and private institutions promote mediation through legislation, guidelines, and training programs.
