Contentions

Contentions are claims or positions advanced in support of an argument, debate, or legal proceeding. The term denotes what a party asserts to be true or disputed, rather than what has already been proven. Contentions function as the core statements that guide the development of arguments, evidence, and legal authorities in a given matter.

In legal contexts, contentions often appear in pleadings, submissions, or case management documents. They may be described as contentions of fact and law, reflecting the party’s positions on what facts are established or disputed and which legal principles apply. A set of contentions helps organize the issues for the court or tribunal and typically maps onto the evidence and authorities the party intends to rely on. Contentions can be revised as the case progresses, within procedural rules, and they are usually tested through cross-examination, filings, and hearings.

Outside litigation, contentions are the main propositions a speaker or writer argues to persuade an audience. In debates, policy discussions, or scholarly work, they are the backbone of the argument, often accompanied by supporting data, sources, and logical reasoning. Clear contentions are typically explicit, precise, and limited in number, to avoid ambiguity and to facilitate evaluation by others.

While contentions denote asserted positions, they are not conclusions; they require evaluation against evidence and counterarguments.
