Bezirksgericht

Bezirksgericht is a district court name used in several German-speaking jurisdictions, most prominently in Austria. In contemporary Austria, Bezirksgerichte are the lowest tier of the ordinary judiciary and operate within defined districts (Bezirke). They handle a broad range of civil and criminal matters that arise in daily life and are not reserved for higher courts.

In civil matters, Bezirksgerichte decide disputes such as contracts, property, family issues (including certain guardianship and juvenile matters), and probate within their district. They also hear a variety of disputes related to tenancy and small-scale civil claims. In criminal matters, they conduct trials for offenses typically considered less serious, while more serious crimes are heard by higher courts (Landesgerichte). Proceedings are conducted under national law, and decisions can be appealed to the Landesgericht.

Bezirksgerichte are located in every district and form part of Austria’s ordinary judiciary (Ordentliche Gerichtsbarkeit). They are presided over by professional judges and operate under the supervision of the state-level judiciary; decisions can be appealed to the regional courts and, ultimately, to the Supreme Court.

Outside Austria, the term Bezirksgericht has different meanings or is historical in some jurisdictions. In Germany, the corresponding local court is today the Amtsgericht; in certain cantons of Switzerland or Liechtenstein, the term may appear in historical documents or in different administrative contexts.
