Bevislagstiftning

Bevislagstiftning refers to the law governing evidence in legal proceedings. It defines what evidence can be used, how it may be obtained, and how it is evaluated by the courts. The aim is to secure a fair trial and reliable decision-making by balancing the rights of the parties with the needs of fact-finding.

Core elements include admissibility (relevance, authenticity, reliability), and the types of evidence such as direct versus circumstantial proof, documentary and digital records, witness testimony, and expert opinions. Bevislagstiftning also covers rules on hearsay, privilege, and the chain of custody for physical or digital material. It regulates disclosure obligations, privacy and data protection considerations, and the exclusion or suppression of illegally obtained evidence.

Bevislagstiftning evolves to address technological changes while safeguarding fair process. In Norway, evidentiary rules are shaped by Straffeprosessloven and Tvisteloven, with courts determining admissibility and weight.
