Bergrecht

Bergrecht, literally “mining law,” is the body of rules that govern the exploration, extraction, processing, and sale of mineral resources in German-speaking areas. Historically, Bergrecht referred to the sovereign or feudal rights to mine and to regulate mineral resources, distinct from general civil law. It encompassed the granting of mining privileges, definitions of mining claims, procedures for licensing and compliance, taxation and royalties, and the duties and responsibilities of mining operators.

In medieval and early modern periods within the Holy Roman Empire and successor states, mining rights were a valuable form of state power and were administered by specialized institutions such as a Berggericht (mining court) and a Bergamt or Bergwesen (mining administration). The scope of Bergrecht also covered safety rules, water management, ore processing, and later environmental considerations.

A central concept in Bergrecht is the right to extract minerals from a given area, often tied to the landowner but sometimes exercised through grants or privileges. In some regions there were forms of “free mining” that allowed subjects to pursue mineral finds with certain regulatory permissions in place. Over time, Bergrecht was codified in more formal mining laws—historical Bergordnungen and, in modern times, state and federal mining acts—defining how concessions are granted, how royalties are paid, how mines are operated and closed, and how risks and environmental impacts are addressed.

Today, Bergrecht has largely evolved into contemporary mining law in German-speaking countries, with regulations at federal and state levels in Germany, Austria, and Switzerland that address exploration rights, property questions, safety, environmental protection, and fiscal regimes.
