The overarching aim is to regulate private relationships in a manner that protects the welfare of those involved, especially children.

Procedures are typically conducted in the civil courts (rechtbanken) in the Netherlands, with specialized divisions for family law. Parties may initiate proceedings themselves, and courts may order mediation or conciliation. In cases involving child protection concerns, the Raad voor de Kinderbescherming can be involved to assess the child’s welfare. The guiding principle in decisions affecting children is the best interests of the child, which informs custody arrangements and related orders.

Outcomes include court orders for divorce or dissolution, custody and parental authority arrangements, visitation regimes, and maintenance for both children and former spouses. Property division is typically governed by the matrimonial property regime. Decisions regarding adoption or guardianship can also be resolved in family cases. Decisions can be appealed to the Court of Appeal (Gerechtshof).

Enforcement of orders is carried out under civil procedural rules, with mechanisms to ensure compliance, such as enforcement procedures. Cross-border issues may arise in international families and may involve European and international private-law instruments and cooperation.
