Välitysprosessi, often translated as mediation process, is a structured method for resolving disputes or conflicts between two or more parties. It involves a neutral third party, known as a mediator, who facilitates communication and negotiation. The mediator does not make decisions for the parties but rather guides them towards finding their own mutually acceptable solutions. The core principle of mediation is voluntariness; parties enter into the process willingly and retain control over the outcome.

The typical mediation process begins with an introduction where the mediator explains their role, the process itself, and the ground rules. This is followed by a joint session where each party has an opportunity to explain their perspective and concerns. Subsequently, the mediator may meet with each party separately in private sessions, called caucuses, to explore underlying interests and potential solutions in a confidential setting. Throughout the process, the mediator helps identify common ground, clarifies misunderstandings, and encourages creative problem-solving.

If successful, the parties reach an agreement, which is often documented and can be legally binding if the parties choose. Mediation is widely used in various contexts, including family disputes, workplace conflicts, commercial disagreements, and community issues. Its advantages include cost-effectiveness, speed, preservation of relationships, and a higher rate of compliance with agreements compared to adversarial methods. However, mediation is not suitable for all disputes, particularly those involving significant power imbalances or where legal precedent is crucial.
