Rechtsgebieden

Rechtsgebieden are the main subject-matter divisions within the legal system. They categorize rules and procedures according to the type of social relations they regulate, such as private relations between individuals, actions of public authorities, or cross-border issues. The concept helps lawyers, judges, and students navigate the law and provides a framework for education and professional specialization.

Most rechtsgebieden fall into private law (privaatrecht) and public law (publiekrecht). Private law includes contract law (verbintenissenrecht), property law (goederenrecht), family law (familierecht), and inheritance law (erfrecht). Public law covers constitutional law (constitutioneel recht) and administrative law (bestuursrecht), and criminal law (strafrecht). Tax law (fiscale recht) is often treated as a separate area. International law (internationaal recht) and European Union law (Europees recht) are cross-border domains that intersect with several fields. Other notable rechtsgebieden include labor law (arbeidsrecht), intellectual property law (auteurs- en octrooirecht), environmental law (milieurecht), health law (gezondheidsrecht), and ICT/technology law (ICT-recht).

Education and practice are organized around these categories: law schools offer courses and specializations by rechtsgebied; legal practice typically requires focus on one or more fields; judges and prosecutors apply rules and procedures corresponding to specific areas. Many issues cross rechtsgebieden, requiring interaction between, for example, environmental and administrative law or commercial and intellectual property law.

In the Dutch system, these divisions aid clarity in legislation, case law, and professional training, while cross-cutting fields and international law ensure ongoing interaction among areas.
