Portretrecht

Portretrecht is a Dutch legal concept that gives individuals control over the use of their likeness in portraits or other recognizable images. It applies to photographs, drawings, and digital images in which a person can be identified. The right is intended to protect a person’s privacy and personal dignity by regulating how their image may be published, shared, or commercialized.

The scope of portretrecht centers on the depicted person’s consent. In principle, publishing or distributing a portrait without consent can be prohibited, especially for private individuals. The rights are typically exercised against the photographer, publisher, or platform that uses the image. The owner of the image may still have copyright in the photograph, but portretrecht concerns the use of the depicted person’s likeness rather than authorship of the image itself.

There are important exceptions and limitations. Journalistic reporting, documentary work, or use in cases of public interest may be permitted under certain conditions, balancing portretrecht with freedom of expression and information. Public figures or images taken in public settings may enjoy broader leeway, but the duty to avoid humiliating or unfair portrayals remains relevant.

Enforcement and remedies usually involve civil action, with possibilities for injunctions, removal of the image, or damages. In practice, photographers and publishers often seek consent in advance or rely on licensing arrangements to avoid disputes.

Portretrecht is a distinct component of Dutch image rights, intersecting with privacy law and copyright. It emphasizes the control individuals have over the use of their own likeness while recognizing legitimate press and expressive interests under specified conditions.
