Migrationsöverdomstolen

Migrationsöverdomstolen, commonly translated as the Migration Court of Appeal, was a specialized chamber within Sweden’s highest administrative court, the Högsta förvaltningsdomstolen (the Supreme Administrative Court). Its remit was to hear appeals in migration-related cases, including asylum decisions, residence permits, and related matters such as family reunification and deportations. The court acted to ensure consistent application and interpretation of migration law across lower administrative tribunals.

Cases typically reached Migrationsöverdomstolen after review by the Migration Court (Migrationsdomstolen) or other administrative courts, upon appeal by individuals or entities dissatisfied with prior rulings. Panels of judges with expertise in administrative and immigration law presided over these appeals, and in some instances the court issued guidance that formed binding precedents for other migration bodies and lower courts.

Procedurally, the court followed standard appellate processes: written submissions, possible oral hearings, and the authority to overturn, uphold, or remand decisions to lower courts. Its jurisprudence addressed interpretation of national migration rules as well as relevant EU directives and case law, contributing to a cohesive national approach to asylum and immigration issues.

Historically, Migrationsöverdomstolen operated as a dedicated migration appellate body within Sweden’s judiciary, helping harmonize migration jurisprudence across the country. In the course of reforms to the migration adjudication system in the early 21st century, its specific functions were reorganized, and migration appeals were redistributed within the broader court structure.
