Marktconvenanten

Marktconvenanten are voluntary, non-binding agreements between market actors—such as producers, distributors, and retailers—and sometimes public authorities, aimed at shaping the operation of a market or sector. They are used as policy instruments to implement objectives more flexibly and quickly than formal regulation, and to establish common standards of conduct for participants.

A typical marktconvenant defines the scope of the agreement, the commitments of signatories (for example on price transparency, service quality, sustainability criteria, or competition practices), and the governance arrangements (steering groups, signatories, and decision-making processes). They also include arrangements for monitoring and reporting, with metrics and regular reviews, and specify the duration and conditions for renewal or exit. Compliance relies largely on voluntary adherence and reputational incentives, though in some cases the covenant can be embedded in procurement contracts or supported by sector-specific legislation.

Marketconvenanten are commonly used in areas such as the energy transition (for instance, agreements on efficient energy use, renewable procurement, or demand-side management), construction and housing (sustainable procurement and performance criteria), waste management, and consumer markets (transparency and fair terms). They function as instruments of collaborative governance intended to align the interests of multiple stakeholders without creating new regulatory burdens.

Critics point to potential weaknesses in enforceability, unequal participation, or the risk that influential actors shape the agenda. Proponents emphasize their flexibility, adaptability to technological developments, and the ability to foster cooperative solutions and quicker market alignment. In the Netherlands, marktconvenanten are frequently used by government bodies and industry associations as tools to guide policy implementation and market behavior.
