Loversampling

Loversampling refers to the practice of a musician or producer incorporating a portion of a previously recorded song, typically a melodic or rhythmic element, into a new composition without obtaining explicit permission from the original rights holder. This borrowed segment is often referred to as a "sample." The term "loversampling" implies a creative appropriation, suggesting the new artist admires or is inspired by the original work, rather than intending outright theft.

The legality of loversampling is a complex issue governed by copyright law. In most jurisdictions, using copyrighted material without permission constitutes copyright infringement, regardless of the artist's intent. This can lead to legal disputes, including lawsuits for damages and injunctions to prevent further distribution of the infringing work.

However, the practice remains prevalent in various music genres, particularly hip-hop, electronic dance music, and pop. Artists may attempt to avoid legal repercussions through various means. One common method is to "clear" the sample, which involves negotiating a license with the copyright holder. This usually entails paying a fee and/or giving the original artist a percentage of the royalties from the new song. Another approach is to significantly alter the sample, making it unrecognizable or difficult to trace, though this does not always absolve the user of infringement.
