Lahjendamine

Lahjendamine is the Estonian term for bribery. It refers to offering, promising, giving, or accepting something of value to influence the actions of a person in a position of authority, such as a civil servant, judge, procurement official, or business partner. The aim is to obtain favorable treatment, contracts, regulatory decisions, or other improper advantages.

Bribery can take many forms, including cash, gifts, hospitality, travel, or favors, and can occur in both public and private sectors. It may involve active bribery (the briber) or passive bribery (the recipient), and can include facilitation payments in some jurisdictions.

Key elements are the transfer of value, improper intent, and an influenced decision or action. The boundary between legitimate gifts or hospitality and bribery depends on context, policy, and law.

Legal and international context: Most countries criminalize bribery. International standards include the OECD Anti-Bribery Convention and the United Nations Convention against Corruption, which promote enforcement and corporate compliance.

Prevention and impact: Bribery distorts markets, undermines trust, and raises costs for society. Prevention relies on transparency, due diligence, codes of conduct, training, and anti-bribery management systems such as ISO 37001.
