Kosmetikaförordningen

The Kosmetikaförordningen, or the Cosmetics Regulation, is the primary legal framework governing cosmetic products within the European Union and the European Economic Area. Its full title is Regulation (EC) No 1223/2009. This regulation aims to ensure a high level of protection for human health and to facilitate the free movement of cosmetic products within the internal market.

Key aspects of the Kosmetikaförordningen include stringent requirements for product safety. Before a cosmetic product can be placed on the market, it must undergo a rigorous safety assessment. This assessment considers the product's composition, its toxicological profile, exposure levels, and the characteristics of the target population. A comprehensive Product Information File (PIF) must be compiled and maintained by the responsible person for each product.

The regulation also establishes rules for the labeling of cosmetic products, requiring clear and accurate information to be provided to consumers, including ingredients, warnings, and instructions for use. It also sets out prohibitions and restrictions on certain substances that may be used in cosmetic products, such as banned or restricted colorants, preservatives, and UV filters.

Furthermore, the Kosmetikaförordningen designates a "responsible person" for each product placed on the market. This can be a manufacturer, an importer, or a distributor, who is legally accountable for ensuring the product's compliance with the regulation. The regulation also mandates notification of cosmetic products to the European Commission through the Cosmetic Products Notification Portal (CPNP). This system helps authorities monitor the market and respond to any safety concerns.
