Fratrædelsen

Fratrædelsen refers to the act of leaving employment in Denmark. It encompasses several distinct situations, including resignation by the employee, dismissal by the employer, and mutual termination of the employment contract. The specific terms and conditions surrounding fratrædelsen are primarily governed by Danish employment law, collective agreements, and individual employment contracts.

When an employee resigns, they must adhere to the notice period stipulated in their contract or collective agreement. Failure to do so may result in consequences such as financial penalties. Similarly, if an employer dismisses an employee, they must also observe the relevant notice periods, which often vary based on the employee's length of service and position. In cases of gross misconduct, an employer may be entitled to dismiss an employee with immediate effect, without notice.

Mutual termination, also known as a settlement agreement, occurs when both the employer and employee agree to end the employment relationship on mutually agreed terms. This often involves negotiating specific conditions regarding the final day of employment, any severance pay, and other post-employment arrangements. Regardless of the reason for fratrædelsen, employees are generally entitled to receive their final salary, accrued holiday pay, and a written employment certificate detailing their period of employment and job responsibilities. The legal framework aims to ensure fair treatment and clarity for both parties during the transition.
