Fedezettügyekkel

Fedezettügyekkel refers to secured transactions, that is, deals in which a creditor obtains a security interest in collateral to guarantee the performance of the debtor, typically the repayment of a loan or obligation. The term combines fedezet (collateral or security) with ugylet (transaction), and it is used in banking, finance, and commercial law to distinguish secured from unsecured arrangements.

Key features of fedezettügyekkel include the identification and pledging of collateral, the creation of a security interest through a contract or statutory mechanism, and the creditor’s right to enforce the collateral if the debtor defaults. The collateral can be real assets such as real estate or vehicles, or financial instruments and other valuables. In case of default, the creditor may realize the collateral to satisfy the outstanding debt, with enforcement procedures and priority determined by the security agreement and applicable law.

Common types of secured transactions encompass mortgage-type arrangements on real estate, loans secured by movable collateral (such as vehicles or equipment), secured lines of credit with pledged assets, and financing instruments like repurchase agreements or secured bonds where collateral supports the creditor’s claim.

From a regulatory and risk management perspective, fedezettügyekkel involve collateral valuation, ongoing monitoring, and considerations such as margin requirements and haircuts. In Hungarian law, security interests are governed by mechanisms like zálogjog (pledge) and jelzálogjog (mortgage), which define the creation, scope, and enforcement of guarantees and prioritize creditors’ claims in enforcement events.
