Einwendung

Einwendung is a legal term in German law that denotes an objection or challenge raised by a party in response to another party’s statements, evidence, or to a procedural step within a proceeding. It serves to question the accuracy, relevance, or legality of asserted facts or of how a case is being handled, and to have those points reconsidered as the process continues.

In civil and administrative proceedings, Einwendungen are used to contest facts presented by the opposing party, to challenge the admissibility or weight of evidence, or to object to procedural actions. They are typically articulated with specific grounds and may be accompanied by supporting documents or references to law. The purpose is to persuade the court or authority to adjust the course of the process, to order further evidence, or to revise a claim or assessment.

Einwendungen can arise in various contexts, including civil litigation, administrative procedures such as planning and permitting, or tax and other public-law procedures. In administrative practice, affected parties may file Einwendungen during public participation or objection phases to influence decisions on regulations, plans, or specific administrative acts.

Relation to other terms varies by jurisdiction and context. Widerspruch (or Einspruch) is often the term used for a formal objection to a final decision, while Einwendung commonly refers to objections directed at facts, grounds, or procedural aspects during the ongoing process.
