Eigentümerstellung

Eigentümerstellung refers to the legal position of an owner in German law. It signifies the comprehensive bundle of rights and powers that an owner holds over their property. This position is fundamentally protected by the German Basic Law (Grundgesetz), specifically Article 14, which guarantees the right to property and inheritance. Eigentümerstellung encompasses several key aspects: the right to possess (Besitz), the right to use (Gebrauch), and the right to dispose of (Verfügung) the property.

The right to possess allows the owner to physically hold and control the property. The right to use grants the owner the ability to derive utility and benefit from the property, whether for personal enjoyment or economic gain. The right to dispose of is perhaps the most significant aspect, enabling the owner to sell, gift, lease, or otherwise transfer ownership of the property to another party. Furthermore, Eigentümerstellung includes the right to alter or destroy the property, within the bounds of public law and the rights of others.

However, this position is not absolute. The law imposes certain limitations to balance the owner's rights with the interests of the community and neighboring property owners. These limitations can arise from public law, such as zoning regulations, building codes, and environmental protection laws, or from private law, like easements and neighborly rights.
