EUhankintalainsäädäntö refers to the legal framework governing public procurement within the European Union. It regulates how public authorities, such as national governments, regional and local administrations, and certain public bodies, purchase goods, works, and services. The primary goal of the EU procurement rules is to ensure a single market for public contracts, promote fair competition, and enhance transparency and value for money.

The legal basis for EUhankintalainsäädäntö is set forth in Article 34 of the Treaty on the Functioning of the European Union, which prohibits discrimination and restrictions on the free movement of services and goods. The key legislative instruments are Directive 2014/24/EU on public procurement and Directive 2014/25/EU on procurement of works, supplies, and services by entities in the energy, water, transport, and postal services sectors. These directives specify thresholds for procurement procedures, the types of procedures (open, restricted, negotiated, etc.), and the criteria for award award. Implementing legislation in each Member State adapts the directives to national contexts while preserving EU core principles.

Core principles include the principles of transparent and non-discriminatory procedures, optimal use of public funds, equal treatment for all suppliers, and the right to challenge procurement decisions. The EUhankintalainsäädäntö also sets out procedures for competition checks, reserve price rules, and the use of electronic procurement platforms. Recently, the European Commission has introduced a Digital Services Act and updated procurement rules to encourage digitalization and sustainability, affecting procurement of IT services and environmentally friendly goods. The evolving legal framework continues to shape public procurement across the EU, aiming to balance competition, economic efficiency, and the public interest.
