Átruházható

Átruházható is a Hungarian adjective used to describe a right, claim, asset, or obligation that can be transferred from one person or entity to another. The term indicates the potential for assignment or conveyance, typically through mechanisms such as átruházás (assignment) or engedményezés (cession of a claim), subject to applicable laws and contract terms.

The concept is commonly applied to contractual rights, receivables, licenses, and property rights. Rights that are inherently personal or dependent on individual performance, or that are explicitly restricted by law or contract, may be átruházhatatlan (non-transferable). Whether a specific right is transferable depends on legal provisions, the nature of the right, and any agreements between the parties.

In a legal context, transferability is governed by statutory rules and contractual arrangements. Many rights and claims can be transferred with the appropriate formalities, notices, or consents, while some transfers require consent of a third party, public authorities, or comply with formalities (for example, written form or registration) to be effective and enforceable.

In practice, clarifying a right’s transferability in contract drafting helps determine who may hold or exercise the right after transfer. If rights are átruházható, the assignee generally steps into the shoes of the transferor, acquiring the rights and obligations associated with them. Conversely, if a right is átruházhatatlan, transfer would be limited or prohibited by design.
