töövõtulepingut

Töövõtuleping, often translated as a contract for work or a work contract, is a legal agreement in Estonian law where one party, the contractor (töövõtja), undertakes to complete a specific work or produce a certain result for another party, the client (töövõtulepingu<bos> on leping, millega töövõtja kohustub tegema valmis teatud töö või tootma teatud tulemuse, samal ajal kui tellija kohustub selle töö eest maksma tasu. This type of contract is distinct from an employment contract (tööleping). The key difference lies in the nature of the obligation: in a work contract, the focus is on the outcome or result of the work, whereas in an employment contract, it is on the performance of work under the employer's direction and control.

The parties in a töövõtuleping are the contractor and the client. The contractor is responsible for organizing the work and bears the risk associated with its completion, unless otherwise stipulated in the contract. The client's primary obligation is to pay the agreed-upon remuneration upon the satisfactory completion of the work. The contract can specify details such as the scope of work, deadlines, quality standards, and payment terms.

Töövõtulepingud are commonly used for various services, including construction, repairs, creation of intellectual property, and other projects where the final product or outcome is the primary concern. Estonian law, primarily governed by the Law of Obligations Act (Võlaõigusseadus), provides a framework for these agreements, outlining the rights and obligations of both parties and provisions for breach of contract.
