Locatar is a Romanian term used to designate a person who occupies and uses a property that is rented from an owner under a lease or tenancy agreement. The locatar typically pays rent and utilities and must comply with the terms of the contract, the building rules, and applicable laws. The corresponding owner or landlord is known as the proprietar.

Legal framework and scope. In Romania, tenancy relationships are governed primarily by the Civil Code and the terms set out in the lease contract, with additional protections that may apply depending on the housing legislation and the type of tenancy. Leases can be for a fixed term or open-ended, and may include provisions on deposits, notice periods, subletting, and conditions for renewal or termination.

Obligations of the locatar. Key duties usually include paying rent on time, maintaining the property in reasonable condition, notifying the landlord of needed repairs, restoring the premises at the end of the tenancy, and not engaging in activities that would breach the lease or disturb neighbors. Subletting or transferring the tenancy generally requires the landlord’s consent, as provided in the contract and applicable law.

Rights of the locatar. The locatar has the right to use and enjoy the rented property, to receive essential repairs and services as stipulated, and to relation-specific protections against unlawful eviction or arbitrary termination, subject to contract terms and legal procedures. The landlord must respect privacy, provide key information, and return any security deposit according to the agreement and law.
