Gjykatave is the Albanian term for courts and, in common usage, refers to Albania’s judiciary as a system. The word is the plural of gjykatë, and the form gjykatave appears in phrases such as “to the courts” or “of the courts.” In Albanian discourse, it denotes the network of institutions that hear, decide, and enforce legal disputes.

The Albanian court system is structured in several levels. The base level consists of district courts (Gjykatat e Rrethit Gjyqësor) that handle civil and criminal cases at the local level. Above them are the courts of appeal (Gjykatat e Apelit), which review decisions from district courts. The highest judicial authority for most disputes is the Supreme Court (Gjykata e Lartë), which oversees the uniform application of the law and serves as the final appellate instance. There is also an Administrative Court (Gjykata Administrative) that handles disputes between individuals and public institutions. For constitutional questions, the Constitutional Court (Gjykata Kushtetuese) interprets the Constitution and protects fundamental rights. The judiciary operates under statutory law and the Constitution, with specialized civil, criminal, and administrative divisions within the courts.

Functions of the gjykatat include interpreting and applying laws, resolving civil and criminal disputes, protecting fundamental rights, and ensuring due process. Rulings are issued as judgments that can be subject to appeal, and courts work within a framework that seeks independence and impartiality.

Historically, Albania’s judiciary has undergone reforms aimed at strengthening independence, efficiency, and the rule of law, including post-1990 changes and ongoing reforms in the context of European Union integration and governance modernization.
