Erfðamiðlun is the process of mediation in inheritance matters, a form of alternative dispute resolution used to resolve disagreements among heirs, executors, beneficiaries, and sometimes trustees regarding the distribution of an estate, interpretation of a will or trust, or the duties of an executor. The aim is to reach a voluntary agreement without litigious court action, while preserving relationships and privacy. The term combines erfð (inheritance/heredity) and miðlun (mediation).

Typically, erfðamiðlun begins by agreement of the parties or by a court referral. A neutral mediator with training in estate law or dispute resolution facilitates sessions. Parties prepare by assembling the will, inventory of assets and debts, valuations, tax considerations, and any relevant correspondence. In joint or separate sessions, the mediator helps identify interests, propose options, and structure a settlement.

Settlements from erfðamiðlun may decide how assets are divided, how to value and transfer unique possessions, how debts and taxes are paid, timing of distributions, and the management or appointment of executors and trustees. If a binding agreement is reached, it can be incorporated into a probate process or enacted as a contract; if not, disputes may continue in court.

Benefits include speed, lower costs, confidentiality, and the preservation of family relationships. Limitations include the need for voluntary participation, potential power imbalances among parties, and the fact that not all issues can be resolved through mediation. Complex tax, fiduciary, or legal questions may still require independent legal advice and court involvement.
