bruiksrecht is a Dutch legal concept referring to a right of use and enjoyment of land or property that is owned by another party. It is formally recognized within civil law and allows the bruiker (user) to exercise specified uses of the land for a fixed or indefinite period. The term is often applied to rights concerning the use of roads, private gardens, forests, watercourses, and industrial facilities.

The concept originates from medieval feudal law, where it evolved into a contractual arrangement between a landowner and a user. In contemporary Dutch legislation the bruiksrecht is regulated through a combination of civil code provisions, easement law, and specific statutes such as the Dutch Water Authority regulations for water rights, and the Forest Act for rights of forest use. A bruiksrecht may be established through express agreement, quasi-contractual recognition, or by customary use that has gathered the effect of a legally enforceable right.

Key characteristics of a bruiksrecht include that it does not confer ownership, it is limited to the specified use, and it may carry obligations such as maintenance or payment of fees. Execution of a bruiksrecht typically requires registration in the Land Registry to provide legal certainty and to inform third parties. The right may be assigned or transferred, but the original owner retains the residual rights and may impose reasonable restrictions to protect the property.

In practice, bruiksrecht is used in contexts such as permitting a resident to use a communal parking space, granting a farmer access to water for irrigation, or allowing a company to maintain a rail track on another's land. The concept ensures that users have a secure protection while maintaining the primacy of property ownership for the landowner.
