Venjuréttur

Venjuréttur, or the right to vengeance, is a historical legal concept rooted in traditional Icelandic law and societal customs. It refers to the principle that an individual or family could seek retribution for a wrongdoing, such as murder or severe injury, through direct action rather than relying solely on formal legal proceedings. This concept was particularly prominent in Iceland’s early legal system, which was based on the *Grágás* (Gray Goose), a collection of laws compiled in the 13th century.

Under venjuréttur, the victim’s family or kin had the authority to pursue justice independently, often through violent means, if the legal system failed to deliver a satisfactory resolution. This practice was deeply embedded in Iceland’s *alþingi* (Althing), the world’s oldest parliament, which operated under a system of self-governance and community-based justice. The right to vengeance was balanced by the principle of *blóðfjórðungur* (blood feud), where retaliation could be limited to the immediate kin of the offender to prevent escalation into broader conflict.

Over time, as Icelandic legal systems evolved and centralized authority strengthened, venjuréttur gradually declined. By the 19th and 20th centuries, formal courts and police forces replaced the need for personal retribution. Today, venjuréttur is primarily studied as a historical and cultural phenomenon, reflecting Iceland’s unique legal traditions and the challenges of maintaining order in a decentralized society. It remains a subject of interest in discussions about justice, revenge, and the transition from customary law to modern legal systems.
