Utlendingsloven

Utlendingsloven is the Norwegian law that governs the entry, residence, work and removal of foreign nationals in Norway. It provides the framework for who may enter the country, what permits are required to stay, and how decisions are made when the stay is granted, limited or refused. The act is intended to ensure orderly immigration, protect national security and public order, and safeguard the rights of applicants.

The law covers a range of purposes for staying in Norway, including work, study, family reunification, protection as a refugee or otherwise in need of protection, and other temporary or permanent residence permits. It sets criteria for eligibility, such as identity, documentation, means of support, housing, and adherence to laws. The act also regulates return and enforcement for those who do not meet the criteria or whose residence has ended.

Decision-making under the Utlendingsloven is carried out primarily by the Utlendingsdirektoratet (UDI) in initial cases. If an application is refused or a residence permit is revoked, the decision can be appealed to the Utlendingsnemnda (UNE), the Immigration Appeals Board. All decisions must respect applicable human rights standards and may involve hearings, evidence requirements, and temporary protections in certain circumstances.

Enforcement measures, including return or removal, are governed by the act, with provisions for voluntary departure, detention in specific cases, and procedural safeguards. The law is complemented by regulations and international obligations, and is applied in coordination with Norwegian courts and other relevant authorities.
