Tsiviilõigusrikkumine

Tsiviilõigusrikkumine, in Estonian civil law, refers to a violation of a civil legal norm, which results in damage to another person or their property. Unlike criminal offenses, which are prosecuted by the state and carry penalties such as imprisonment or fines, civil offenses primarily lead to civil liability. This means the responsible party is typically obligated to compensate the injured party for the harm caused.

The core concept behind tsiviilõigusrikkumine is the breach of a duty owed to another individual or entity within the framework of civil law. This can encompass a wide range of actions or omissions, including breaches of contract, torts (such as negligence or trespass), or violations of property rights. The intent of the perpetrator is often a factor in determining the extent of liability, but negligence can also be sufficient grounds for establishing a civil offense.

When a tsiviilõigusrikkumine occurs, the injured party has the right to seek legal remedies. The most common remedy is financial compensation, known as damages, intended to restore the victim to the position they were in before the offense occurred. In some cases, injunctive relief may also be sought, compelling the offending party to cease certain actions. The burden of proof generally lies with the claimant, who must demonstrate that a civil wrong was committed and that it caused them quantifiable harm.
